Alcohol Disclaimer

This is a dry-hire bartending service only.

The Pour does not sell, supply, deliver, or provide alcohol under any circumstances. The client is solely responsible for purchasing, providing, transporting, and legally possessing all alcohol served at their event. The Pour provides only bartending labor, equipment, mixers, garnishes, and non-alcoholic supplies.

Placeholder terms — pending attorney review before launch.

1. Overview of Services

The Pour LI provides dry-hire mobile bartending. We supply staff, mobile bar cart, tools, aesthetically pleasing disposable cups (we do not provide glassware), mixers, garnishes, ice-service labor, and non-alcoholic supplies. The client provides all alcohol, ice as agreed, venue access, and any required permits.

2. Client Legal Responsibility for Alcohol

The client is solely responsible for lawfully purchasing, transporting, and possessing all alcohol served. The Pour holds no liquor license and is not a seller of alcohol under New York Alcoholic Beverage Control law. Where local law requires a permit for service, the client is responsible for obtaining it.

3. Booking, Deposit & Payment

A 50% non-refundable deposit reserves the event date. The remaining balance is due seven (7) days before the event unless otherwise stated in a signed proposal. Payment is processed via Stripe; ACH may be available on request.

4. Cancellation & Refund Policy

  • 60+ days before event: full refund of deposit.
  • 31–59 days before event: 50% refund of deposit.
  • 0–30 days before event: no refund; balance may be waived at company discretion.
  • Rescheduling within 12 months is offered once at no additional fee, subject to availability.

5. Client Conduct & Venue Conditions

Client agrees to provide a safe working environment: level bar location, access to potable water and electricity if pre-arranged, shelter from severe weather for outdoor events, and reasonable protection for staff and equipment.

6. Liability & Damages

The client is responsible for damage to The Pour's equipment caused by guests or venue conditions. The Pour's liability is limited to the amount paid for services under the applicable booking.

7. Staff Conduct

All bartenders are certified and adhere to responsible service standards. Staff present in professional attire, arrive on time, and follow venue rules.

8. Intoxication Policy

Bartenders reserve the right to refuse service to any guest who appears visibly intoxicated or underage, consistent with responsible-service best practices and applicable dram-shop laws. This decision is final and non-negotiable.

9. Photography & Media Release

Unless the client opts out during booking, The Pour may photograph event setups (bar builds, cocktails, ambient shots — not identifiable guests without consent) for marketing use. An opt-out checkbox is provided on the booking form and can be requested at any time.

10. Governing Law & Dispute Resolution

These terms are governed by the laws of the State of New York. Any dispute will first be addressed through good-faith negotiation; unresolved disputes will be submitted to binding arbitration in Suffolk County, NY.
